I highly recommend Lori and her office, impeccable job, honest, she is very human , who listen and understands.I appreciate the very detailed invoice she gave to me where every dollar spent was explained transparent transaction

J. P.

I initially approached Lori Somekh based upon the fact that she was a fellow alumni from St. John's University. Knowing that the school has many excellent practicing attorneys was important for me, but one that specialized in elder care even more so. I wanted someone with the experience and expertise that could assist me in setting up Power of Attorney for my Grandparents. Lori did a great job. I would definitely recommend her to a friend and plan to use her services again.

Elder Law Practice FAQ

What is the Medicaid look-back period?

To protect your assets and income from the high costs of nursing homes and home care, Medicaid planning should be done before needing care. New York has something called a “look-back” period that determines your Medicaid eligibility. If you apply for Medicaid, the state will look back at your assets, how you spent your assets, and what kind of assets were gifted in the last five years. You might not be eligible for Medicaid coverage if your assets exceed a specific amount.

Why is it important to plan your estate?

Planning your estate is extremely important, regardless of your age or net worth. Estate planning gives you control over your assets and allows you to specify how those assets will be distributed upon death. Estate planning also helps you minimize your estate’s tax liability. In addition, you will be able to better protect your beneficiaries from probate and potential threats to their inheritance.  Finally, estate planning provides peace of mind knowing that your loved ones and those you trust are in a position to provide for your care in the event of incapacitation.

What is probate?

Probate court will facilitate the distribution of assets or debts. A will determines how the court does this, and if there’s no will, then the court determines what happens to your assets, and debts will be collected, managed, and distributed. Probate is the process of using the courts to determine who is going to be responsible for your assets after your passing. The probate process is initiated when someone passes away without an estate plan.

What are things you need to do to plan your estate effectively?

To effectively plan your estate, you will need to make a will, consider making a trust, designate beneficiaries, and plan for incapacity. Additionally, after your estate plan has been crafted, you should update it regularly to reflect any major life changes so that your wishes are carried out no matter the circumstances. Working with an experienced New York estate planning attorney can ensure that your estate plan fully reflects your wishes.
